Specialized Criminal Practice

     Our Criminal Practice began in 1993, receiving case assignments from Napa Superior Courts Felony Conflict Appointment List.  Our representation of clients started with the successful trial defense of a Felony Assault client in 1993, and grew from there.  After a time, we began to find that time constraints required a narrowing of the criminal practice, at which point we left the Conflict Appointment List.  After that, we focused on practicing within special and interesting areas of the Criminal Law.

 

     Our Specialized Criminal Practice focuses on:

Driving Under the Influence (DUI, DWI):   

    We represent clients in Driving Under the Influence (DUI) cases in almost all cases.   Our fee arrangement for most DUI cases is on a fixed (or flat) fee basis, rather than hourly.  We also handle DMV administrative hearings when appropriate.  We have obtained some interesting and outstanding plea agreements, and do not hesitate to take cases to trial when an acceptable plea agreement cannot be reached.

 

    We also represent clients in the DMV Administrative Hearing, if the facts or circumstances are such as that they warrant the expenditure of the expense of pursuing that course of action.  More often, the attorney can provide a service that will allow a suspension to start and end during a time more convenient to the client.

Constitutional Issues: 

    This is an area of great interest to us.  The US Constitution limits the exercise of Governmental powers.  When an arm of Government oversteps its authority and criminal charges are brought against a citizen as a result, an insult is done to all citizens.  In the case of the 4th Amendment's protection against warrantless search, the Exclusionary Rule serves to keep illegally obtained evidence out of court.  We have successfully obtained dismissal of charges against our clients by preparing and filing Motions to Suppress.

Selected Matters: 

    The balance of our Criminal practice is determined on a case-by-case basis.  We are interested in accepting matters in which both counsel and client share a strong and abiding determination that the particular criminal prosecution is unjust and unwarranted.
